Sen. Miriam Santiago slams prosecution team's "bloopers" in Corona impeachment trial

ABS-CBNNews.com reports that on Tuesday, January 24, Sen. Miriam Defensor Santiago "scolded the House impeachment prosecutors for coming unprepared during the fifth day of the impeachment trial of Chief Justice Renato Corona."

 

The report revealed: "Speaking to ANC, Santiago noted that the House prosecution team failed to submit their memorandum on why Bureau of Internal Revenue (BIR) Commissioner Kim Henares and other witnesses and evidence should be presented in the trial to support Article 2 of the Impeachment complaint against Corona."

 

In her ANC interview, Santiago pointed out: "Prosecution should have been ready with their memorandum. They know that when there is a contentious issue during and in the course of the trial, the normal habit is to submit memoranda."

 

She also added: "Dapat handa na sila kaya ako mabagsik sa prosecution [team] dahil sa tingin ko, hindi nila ina-anticipate. Hindi nila iniisip kung ano bang magiging kasunod. Kung batid na abugado yan, may trial brief kung ano ang gagawin niya (They should be ready. That's why I'm being hard on the presecution team because I think they don't anticipate anything. They don't think about what's going to come next. If you're a lawyer, you should have a trial brief that will tell you what you're going to do next)."

 

Santiago went on to enumerate the prosecution team's other "bloopers." The report noted: "(Santiago) said the House prosecution team also failed to say how many witnesses they will present in the trial, which would have ruled out any surprise witnesses in the hearing. She chastised the prosecutors for asking the Senate impeachment court for a more liberal application of the rules in the trial. She said that as lawyers, 'you cannot make this kind of general request or appeals to your judge.'"

    one event last week didnt atract too much attention by the public:the comment of Mr Enrile concerning the survey of UP in the Corona case.
    I think that the comments of Mr.Enrile about the survey of the UP students concerning Corona are unfair and are showing his disdain of what people are thinking,instead of being happy that the youth is concerned about the honorability of some leaders of our nation.May be it is due to his age,thinking that age is a privilege of wisdom and knowledge.He should think of the words of Mr.Charles De Gaulle,former and reputated President of France,when he told the students ,after they protested against corruption in the Government in 1968:"you know young fellowmen,age is sometimes a wreck-age.thank for waking me up"...What a wise men.
    And finally,Mr Enrile,who seems not caring of what people are thinking(he also said that the impeachment trial is an internal affair)-should be reminded that if his is a Senator,it is because he was elected BY the people.So he is also indebted to them,even they are younger..But who cares about people when you are elected.

    The last week it seemed that the prosecution in the Corona case lost ground.
    It seems that some of the senators are bored and do not understand the judicial language .The president of the Senate is also strangely blocking some witnesses,declaring that they are not relevant to the case.How does he know it, if he didn't hear their statement.?I would understand his reaction after the statement of the witness and NOT before??Is he part of the defense or prosecution?
    Ms Santiago,as soon as she recovers from high blood,seems to think that she can push down by shouting everybody who doesn't immediately understand the procedure instead of explaining calmly to the senators how to proceed.Is she a prosecutor or part of the defense?
    If the impeachment fails,there is no possibility of reforms.
    The secrecy of foreign currency in the banks is a joke.Why are foreign currencies protected and not peso accounts.?Thanks the declarations of Santiago,Estrada and Enrile,the main opponents,billions of illegal pesos will be transferred by moneychangers into foreign currencies.
    The declaration of Santiago that the foreign investors might be afraid of investing is an insult to our intelligence.It is not the foreign investor who will hide the accounts because, for his investments in the country, he needs to transfer his currency through the bank system to get pesos for his investments and his current expenses.
    Finally, the non impeachment will mean a loss of ethical moorings. Everybody condone cronyism and corruption and they don’t ostracize or punish the crooks in your midst. May I remember what the Senate President Avellino has said in his speech in 1954:”We politicians are not angels. What are we in power for? When Jesus died on the cross he made the distinction between a good crook and the bad crooks. We politicians can prepare to be good crooks”. What a vision, even it is a cynical one!!
    What about the judicial system in this country. In this country law provides forests where you may skulk and slither and shine in constant fluidity. Some of these forests have been planted by foreigners who had brought with them Latin, the peculiar dialect reserved for God and the law. This was a gift for lawmakers who became masters of camouflage and evasion. Now, whenever danger threatened, they could take cover in thickets of Latin, buying time,misleading,joking,mocking,turning things to their advantage, rewriting events until they took place in some never-never land, a jurisprudential Oz. Threatened officials bluster about "certiorari writs”. A police chief doesn't sack a useless subordinate, he files a petition for "mandamus “against him to make him to his duty, in other words ,an enforcement by law to compel law enforcement. And of course, practically no one of the higher social and political clan ever comes close to going to jail. Even the most appealing crimes arousing public outcry disappear into that enchanted land where judgments and appeals are bounced back and forth between one court and another like a tennis ball in a stupefying rally ,until the defendant dies of natural or "non legal killing(by the way is there a legal killing????)causes or runs out of money and the public outrage has long been superseded by fresher protests and grosser crimes.
    Both cronyism and corruption are wasteful but they allow their practice because of their loyalty is to family or friend,-utang na loob- not to the larger good.

    Sen. Miriam Defensor Santiago is right the prosecution panel. They are the accuser so they should have prepared their weapons ammunition before going war because like our outstanding Senator Miriam, who is always prepared in the Senate when defending a bill or interpellating her colleagues or questioning in the Senate committee hearing and I understand she writes her speeches, she does not rely on her staff unlike other senators who reads only what his staff writes in the plenary without understanding it. BRAVO MIRIAM!!!

    Malinaw na minadali ng kongreso naipasa ang Impeachment ni CJ Corona. Sipsip sa administrasyon kasi makasunod lang at isabali wala ang tunay na bigat ng issue para lamang maging pogi kay kalbo. Sa huli kung tanging kamote ang tinanim kamote din ang aanihin!

    Tama si Sen. Santiago sayang lang ang oras nila at ng publiko. Mas mabuting tumutok na lang ang landas ni kalbong abnoy sa pagpapaunlad ng ekonomiya at issue sa presyo ng langis kaysa personal niyang agenda.

    Since becoming people's representations in the House, those bunch of prosecutors haven't been engaging in court room battles for the longest time. Mapurol pa sa kutsilyo ko mga yan. Lady Miriam was just picking her spots. And she had a field day because apparently, the pickings were a lot.
