Celeb endorsers told to take a leave or risk getting jailed

Published: Feb 11, 2010 - 6:22pm

Celebrities endorsing candidates, such as Kris Aquino, Willie Revillame, and Dolphy, either need to resign or leave their television shows by next week or risk going to jail, reports the Inquirer.

According to the Parish Pastoral Council for Responsible Voting (PPCRV), it is mandatory for celebrities or any prominent media personality endorsing any running politician to leave their respective shows and networks in accordance to Section 6 (6.6) of the Fair Election Act which states:

"Any mass media columnist, commentator, announcer, reporter, on-air correspondent or personality who is a candidate for any elective public office or is a campaign volunteer for or employed or retained in any capacity by any candidate or political party shall be deemed resigned, if so required by their employer, or shall take a leave of absence from his/her work as such during the campaign period."

PPCRV lawyer Howard Calleja told the Inquirer that any violation of the Fair Election Act, which would take effect next week, is subject to one to six years of imprisonment. He also stressed that each celebrity's media outfit should stop airing the celebrity endorser's shows while they are campaigning for their respective candidates.

Calleja continued that the Fair Election Act applies to celebrities who are or have been involved in the campaigns in any way, whether their endorsements were shot or recorded prior to the campaign period, since their ads can still be aired during rallies or uploaded onto the Internet.

Presidential aspirant Joseph Estrada told the Inquirer that he had no need for celebrity promotion since his campaign is not a "stage show." It can be noted though that Estrada, himself, is also an actor whose latest movie, Ang Tanging Pamilya is currently being used for his own campaign.

In a separate interview, Presidential candidate, Sen. Jamby Madrigal, recalled how actress Judy Ann Santos' endorsement helped her win in the 2004 Senatorial election: "I have seen the folly of my ways. I'll not do it again."

The United States, the great bastion of freedom and democracy like no other, has a tradition not just of entertainers endorsing presidential candidates but of newspapers doing so. Those newspapers normally explain why they are putting their weight behind their chosen ones in editorials.

What happened here in the Philippines? Who were the idiots who passed this law. Did Comelec misinterpreted the law?

Isn't the right to freely express oneself, and to freely earn a living part of our Constitution?

While I do not like the consequences of celebrity endorsers on our less educated members of the electorate, celebrity endorsers have this right as much as we do. It's dangerous to deny these rights to ANY Filipino citizen. If we allow this law to be passed, we will be surrendering our own freedom.

Give a break naman sa COMELEC. Pinatutupad lang nila ang batas. Kung mi reklamo kayo doon sa mga pulitikong gumawa at nag-approve nito. Pero too late ng baguhin. Mi kasabihang: BE CAREFUL OF WHAT YOU WISH FOR....Kung hindi gawin ng COMELEC ito, eh remiss sila sa kanilang duties, di ba?

@igeramos, first and foremost pinoy ako ha. Pero as I see it, this is a law that was passed in the congress and senate and was signed by a president to be a law. Remember that all of those congressmen and senators are elected by the filipino people. If we will not allow this, our laws will just be laws, and need not be implemented. And as you say, we have to streamline our laws, does that mean that you agree to have a constitutional convention or constitutional assembly to change our laws. Remember, once its a law, its the law.

We can even sue the COMELEC if they do not implement this because this is the law. This is what is really bad with our country, interpretation of laws depend on what is acceptable on the current situation and not on what is the essence of the law when it was created.

Hey COMELEC, why don't you just exert effort on how to resolve cases within 30 days. My God, losers have been mayors or governors for ages before a decision is arrived at. Only in the Philippines - a country run by nuts.

This law is really st*p*d. Only a charlatan can make up something like this. At this point in the game, people already made up their mind whom they will vote for. There's no amount of Kris Aquino doing cartwheels or Willie Revillame dancing wilth Pokwang to convince me to vote for Noynoy or Villar respectively. I've already made up my mind. These people have to work. They have responsibilities. They actually drive the economy. Why deprive them of work? The problem with this country is that we have too much laws. Laws that are not implemented because it overlaps with other acts or ordinances. Can't we just streamline things to make our llves simple?
